When a person speaks loudly and uses aggressive language that doesn’t necessarily mean that he is an awful person, he could still be a nice person and might be there for you when you need him. His language does tell us however, that he is a disturbing person at the very least since he is too loud and his choice of words is usually offensive. This was an example of how language defined an identity to a certain degree, partially and not completely. If another person had mid-terms coming up and I asked him to give me a ride to a really far place, his decision ( not necessarily the language he speaks ) would reveal a fair amount of his identity to me. If he agreed to give me a ride, it would tell me that he cares about other people’s needs and that he is not a selfish person for example. If he disagrees, then that tells me that his mid-terms are top priority for him and he would not waste his time in any way possible until he is done with his mid-terms , in other words he is a serious person. To summarize, I believe that the identity of a person should not only be related to the language that person speaks but also on other factors like life choices. Language is closely related to one’s identity, Baldwin even mentions that language can sometimes reveal the speakers origins and could force out a lot about a particular person, it could give out how you were raised, your self-esteem and confidence and your income for example, a lot of which is tied to one’s identity. To say language defines us completely is wrong and I personally think no one should judge others based on the language they speak only, you should never be able to predict one’s income or how they were raised based on the language they speak. People should not be judgmental. I may have experienced this when I lived in Virginia back when I was a sixth grader and didn’t know much English, some classmates assumed that I was a bad student academically just because I had poor or below average grades in my English and spelling classes. They didn’t realize that it was very hard for me trying to learn a second language while taking other science and advanced grammar classes (for a foreign student at least). After getting our first math quiz results, I noticed how some students started approaching me differently because I managed to get an â€Å"A† on it. This tells me that some students judged my intelligence level based on my limited English, and I think that this is wrong. This quote from Baldwin talks about how language has a strong relationship with identity. Baldwin says: Language is also a political instrument, means, and proof of power. It is the most vivid and crucial key to identity: it reveals the private identity, and connects one with, or divorces one from, the larger, public, or communal identity. There have been, and are, times and places, when to speak a certain language could be dangerous, even fatal. ( 350. ) Baldwin is trying to prove how language plays a major role in revealing one’s identity. Having a language that is accepted and used by the masses makes you feel comfortable and more capable. It is the key to communication between people and by language one could create or possibly sever bonds with people. Baldwin was talking about old England in that last sentence, he says when speaking another language besides English in England, you are also risking your clarity to other people, and everything you say will be incomprehensible for them. The reason I chose this quote was because Baldwin reinforces my claim by mentioning that language defines identity but at the end of his quote he says â€Å"when to speak a certain language could be dangerous, even fatal†. The use of â€Å"could† from Baldwin tells me that Baldwin knows that this is not always the case, language does not always define the identity of some people or that it is not the only key which defines the identities of mankind. Anzaldua says â€Å"So, if you want to really hurt me, talk badly about my language, ethnic identity is twin skin to linguistic identity – I am my language. Until I can take pride in my language, I cannot take pride in myself. † ( 345. ) Anzaldua was saying here that she cannot take pride in herself until she accepts Chicano Texas Spanish and Tex-Mex as legitimate languages. She was very honest here when expressing her feeling ( an example of pathos ). This quote supports my claim, here Anzaldua is talking about â€Å"ethic identity† and â€Å"linguistic identity†, and she specifically mentions those types of identities because those types are completely defined by one’s spoken language and origins. However, there is a whole lot more to identity than just linguistic and ethnic identities. I fully agree with Anzaldua, language is an important part of me and I would be hurt to see anyone talk badly about the language I grew up learning. Language like I said in my claim defines identity so when you speak badly about It, you’re speaking badly of what defines my identity, what defines me. The third quote is from my first short assignment, Alshareef says: The image I’m trying to avoid is an image where I don’t take class work seriously by attending lots of parties in the middle of the week. The one I’m trying to convey to my professor is that I did nothing wrong by going out to the market district at mid-night, the accident could not have been avoided and I should be excused for missing class on Friday, this is how I want my professor to view it, this is possible with clever use of language and a couple of white lies. Language is a tool that everyone in this day and age has access to, you can get in trouble by saying certain things at the wrong times or you could avoid it if you have a silver tongue. In reality, I was out partying all night which is a life choice (another factor which defines identity) that expresses how careless I was during the school week. By using clever language here I am trying to persuade my professor to believe that I was out in the market, while in fact I was partying. I should have done my homework and I have no excuse to skip my class on Friday. I lied to my professor by telling him I was heading to the market district that night. In this quote, I explained how the outcome would be had I told the truth or lied to my professor. My use of language here tells a lot to my professor about me (my identity). I’d like to finish my paper by summarizing my claim, language plays a major role in defining identity, but there are other elements which define identity like life choices. There is more to an identity than the language being spoken by an individual. I don’t want people to judge me based on how I speak a certain language, because there is so much more to me than my language and I want to remind people of this.

A few miles south of Soledad, the Salinas River drops in close to the hillside bank and runs deep and green. The water is warm too, for it has slipped twinkling over the yellow sands in the sunlight before reaching the narrow pool. On one side of the river the golden foothill slopes curve up to the strong and rocky Gabilan Mountains, but on the valley side the water is lined with trees- willows fresh and green with every spring, carrying in their lower leaf junctures the debris of the winter’s flooding; and sycamores with mottled, white, recumbent limbs and branches that arch over the pool. This passage, which serves as the novels opener, establishes from the very beginning the importance of land and nature to the text- specifically, an idealized version of nature. The river runs â€Å"deep and green,† the water is â€Å"warm,† the sands are â€Å"yellow†¦in the sunlight,† the foothills â€Å"golden,† the mountains â€Å"strong,† and the willows â€Å"fresh and green. Each adjective is positive and healthy. Taken together, these descriptions create a romanticized image of the natural world. The passage suggests that the natural world is epic and powerful, the animals and plants living blissfully and peacefully according to their natural rhythms, coming and going as they please, untouched by man’s destructive hand. â€Å"There is a path through the willows and among the sycamores, a path beaten hard by boys coming down from the ranches to swim in the deep pool, and beaten hard by tramps who come wearily down from the highway in the evening to jungle-up near water. In front of the low horizontal limb of a giant sycamore there is an ash pile made by many fires; the limb is worn smooth by men who have sat on it.† Untouched, that is, until the beginning of the second paragraph, when into this scene come â€Å"boys,† and â€Å"tramps,† who wreak all manner of havoc on this natural scene. The path through the willows soon becomes a â€Å"path beaten hard as the men walk all over it, ruining it of its proper tenderness. There is an â€Å"ash pile by many fires,† which suggests more harm to the landscape, both in that it implies the area is well-traveled, as well as because fires are damaging to the ground upon which they burn. Moreover, these frequent visits have â€Å"worn smooth† a tree limb that the men have used as a bench, deforming it. This paragraph introduces the uneasy balance, central to the novel, between an idealized version of the natural world and the actual version in which people live- in other words, the world of mice and the world of men. The more the world of men tries to attain or possess the world of mice, the more they harm it, and consequently the more they lose it. â€Å"That mouse ain’t fresh, Lennie; and besides, you’ve broke it pettin’ it. You get another mouse that’s fresh and I’ll let you keep it a little while.† This statement, made by George to Lennie, reveals Lennie’s gentle nature, as well as his inability to prevent his physical power from bringing destruction upon those smaller than him. Throughout the novel, Lennie is often seen petting soft objects, ranging from a mouse to a rabbit to a womans hair. In this particular passage, nothing of consequence comes of Lennies actions- he is simply touching a dead mouse. However, the moment foreshadows another scene: later in the novel, Lennie attempts to stroke Curleys wifes hair and accidentally breaks her neck in the process. Lennies unintended but inevitable acts of destruction serve as a metaphor for humanitys destructive nature. Despite our best laid plans, the novel suggests, humans cannot help but leave behind a ruinous wake. They’re all the time talkin’ about it, but it’s just’ in their head.† In this speech, a farmhand named Crooks rejects Lennie’s notion that he and George will one day buy a piece of land and live off of it. Crooks claims that he has heard many people make these sort of claims before, but that none of them have ever come to fruition; rather, he says, â€Å"it’s just in their head.† This statement encapsulates Crooks’ (justified) skepticism about George and Lennie’s plan, as well as a deeper doubt about anyones ability to attain whatever idealized sanctuary they have envisioned for themselves. According to Crooks, â€Å"[n]obody never gets to heaven, and nobody gets no land. The dream of having their own farm is a refrain to which the pair often returns throughout the book. Lennie seems to believe the dream is realistic, even if currently out of reach, but for most of the book, it is unclear whether George shares that belief or simply considers it an idle fantasy that helps him get through the day. By the time this scene occurs, however, George is preparing to kill Lennie, and he clearly knows the farm dream will never become reality. Interestingly, even though they have had this conversation before, only now does George assent when Lennie asks him if they can have rabbits- a recurring symbol throughout the book- on the farm. The petition took place on June 2008. It was a punishment that was sentenced to him by the Louisiana court for having been convicted of committing the crime. In accordance to the law, the murders are supposed to be sentenced to death but for the past three decades, only two cases that did not involve murder were registered one for Patrick Kennedy and another one. He was sentenced to death penalty by the Louisiana court on 22nd May 2007 in a case No 05-KA-1981 Louisiana vs. Kennedy. In 2008, Patrick Kennedy decided to challenge the decision by the Supreme Court that was reached in 2007 citing that the sentence was a violation of the 8th constitutional amendment which stated that depending on the rarity of the case, death penalty may not be imposed. Was it in order for the supreme court of America to sentence to death a step father who raped his 8 year old stepdaughter? This is what this research paper will discuss about. Patrick Kennedy was sentenced to death after he was convicted by the Supreme Court to have raped his step daughter who was less than twelve years old. Patrick Kennedy could not understand which statutes were used to sentence him. In his argument, it was a violation of the 8th amendment of the constitution. In another rape case, Coker vs. Georgia, the offender was accused of raping a 16 year old lady but on this case, the Supreme Court ruled that this case was not punishable by death because the victim was more than twelve years old. In the light of the above ruling, it was asked if the stepfather who raped his stepdaughter but did not kill her was bound by the constitution to be sentenced to death. (Hamilton, 2008) According to the Louisiana state, committing such a crime was equal to killing and the only appropriate sentence was death penalty. The majority of the United States had not passed the law but five of them namely Montana, Texas, Oklahoma, Louisiana and South Carolina had already passed it and were in use for example, it was the one that was used in Louisiana to sentence Patrick to death. Though these laws existed in books, they were limited to persons who were in the past convicted of committing crime of assaulting a minor but this only applied to the four states with the exception of Louisiana. The other states were contemplating to extend the death penalty to child rapists. According to the statistics given by the Death Penalty Information Center, death sentence has been on the decline in America for the past years. â€Å"The number of executions has dropped steadily since, hitting a 10 year low of 53 in 2006. † (Lithwick, 2008) According to a survey that was done by Gallop in 2006 concerning the preference between death penalty and life without parole, it was established that more people prefer life sentence to death sentence but this was due to a number of factors for example, some people were sentenced to death judging them on their race. Despite this, majority advocated for murders to be sentenced to death. The decision to review the decision to impose death penalty on child rapists was due to Patrick Kennedy’s case and the pressure that was amounted by the National Association of Social Workers, the Louisiana Foundation against Sexual Assault, and the Texas Association Against sexual assault as well as the National Alliance to end Sexual Violence. These organizations pressurized the supreme court of America to review its ruling on the case. In Patrick’s petition, it was stated that Patrick, â€Å"is the only person in the United States who is on death row for a non-homicide offense. He has been sentenced to die for the crime of rape, an offense for which no person has been executed in this country for over forty years since Missouri executed Ronald Wolfe in 1964. † (Denniston, 2008) The arguments that were put forward by these organizations were that death penalty for child rapists worsen the problem in that many cases of sexual abuse went unreported. Secondly, they argued that no child molester would leave his victim alive to avoid being reported therefore this acted as an incentive to kill victims. The third argument was that those statutes subjected the raped child to many trials and appeals thereby keeping those memories a fresh instead of them being repressed. (Death Penalty Information Center, 2008) It is for these reasons and the appeal that was made by Patrick that led to the reviewing of the ruling by the Supreme Court on 16th April, 2008 in a case between Louisiana and Kennedy. (Hamilton, 2008) It is in this case that it was ruled that the decision to execute Patrick Kennedy for raping his stepdaughter was a contravention to the 8th constitutional amendment that bans death penalty on rare and cruel cases. The majority’s argument was that the penalty should be reserved for the few offenders who are most egregious. (Linda G. , 2008) According to Justice Anthony Kennedy, death penalty was to be imposed on murders. He also differentiated between the first degree murder which is also referred to as intentional murder and the non homicide crime such as rape. He said that the later was more devastating in terms of moral depravity but he said that murder cases due to their nature, severity and irrevocability could not be compared with non homicide. The dissenting judges led by Samuel Alito objected to this observation arguing that, â€Å"The harm that is caused to the victims and the society at large by worst child rapists is grave. †(Biskupic, 2008) In justifying its decision, the state of Louisiana in its briefs argued that raping a child under twelve years is not different from other crimes because its results are devastating and lasts for a life time but in his argument, Justice Kennedy argued that the Supreme court’s decision to nullify Patrick’s case was reached objectively by the judges and this was backed by the fact that many American states were not in agreement with the statute and that was why they had not passed it. (Richey W. 2008) In response to the conclusion reached by Justice Kennedy, Justice Samuel objected to this arguing that many judges and lawyers misinterpreted the 1977’s Coker’s decision on capital punishment. They understood that death sentence should not be applied on any rape cases but that was not the case because in that case the victim was married and had assumed the status of an adult thus she was no longer a minor. He noted that due to this reason, the state’s legislatures have not understood the societal standards in terms of decency. â€Å"Evolving standards of decency must embrace and express respect for the dignity of the person and the punishment of criminals must conform to that rule. † (The Supreme Court in the Kennedy case, O7. 373. PDF) According to the Supreme Court’s statutes, rape is said to be committed where anal sex or virginal sexual intercourse is done without the consent of the victim and if the victim is less than twelve years, lack of knowledge of her age is no defense. If convicted of having committed aggravated rape, punishment should be life imprisonment without parole, suspended sentence or probation but the offender could be punished by death if the District Attorney seeks for capital verdict. In the light of the above, Patrick Kennedy’s case was a rare occurrence and thus he did not deserve the death sentence but deserved life sentence without parole. (Biskupic, News Washington 2008). The decision to reject death penalty was greatly opposed by the conservative judges. Even the two presidential candidates were opposed to the move though no one had been executed since 1964. Justice Kennedy argued that of all the 3300 people on the death row, only two were there for the reasons apart from murder. Justice Samuel questioned this majority logic that murders are more morally depraved than child rapists. â€Å"I have little doubts that the eyes of ordinary Americans, the very worst child rapists-predators who seek out and inflict serous physical and emotional injury or defenseless young children are the epitome of moral depravity. † (Barnes, 2008) In conclusion of this research paper, it is okay to say that the decision by the Louisiana’s Supreme Court to execute Patrick Kennedy for raping his step daughter was harsh and was a contravention to the 8th amendment. Of all the inmates in the death row, only two inmates whose cases were not murder. Patrick’s case was one of those rare cases that were addressed in that amendment. The appeal acted as an opportunity to interpret law as it is this was because according to Justice Samuel, most legislatures misunderstood the decision that was made on Coker’s case and assumed that he meant that death penalty should not be applied on rape cases.
